BMC MALL SDN BHD PERSONAL DATA PROTECTION NOTICE

Introduction

The Personal Data Protection Notice ("the Notice") is issued pursuant to the enactment of the Personal Data Protection Act 2010 ("the Act") to regulate the collection and processing of your Personal Data (as herein defined) by BMC MALL Sdn Bhd, its subsidiaries, associates, jointly controlled entities, affiliates, including but not limited to companies that are part of BMC MALL group of Companies and BMC MALL group of Companies' associates, jointly controlled entities and affiliates (BMC MALL").

Type of Personal Data Collected

BMC MALL may be required to collect personal data from you during the course of your dealings with BMC MALL or for the purpose of BMC MALL’s business activities. Such personal data may include but is not limited to name, preferred name, age, identity card number, passport number, address, gender, date of birth, marital status, information of spouse/children, occupation, profession, designation, income range, contact details such as correspondence address, telephone or mobile number, fax number, credit card details, bank account number, email address, information of employer, race, nationality, signature and such other data necessary for the purpose which the personal data is collected ("Personal Data").

Consent by You

By providing the Personal Data to BMC MALL, you have read and accepted the Notice and you have consented to the processing of the Personal Data by BMC MALL in the manner set out herein. Further, if you have provided the Personal Data of third parties to BMC MALL, you warrant and represent to BMC MALL that you have obtained the required consent of the third parties for the processing of the relevant Personal Data by BMC MALL in the manner set out herein.

Purpose of Personal Data Collected

The personal data provided by you to BMC MALL may be processed by BMC MALL for the following purposes ("the Purposes"):-

  1. To administer the business or contractual relationship between BMC MALL and you and/or your company;
  2. To communicate with you and/or your company;
  3. To administer customer relationship management procedures;
  4. To provide you with information about the activities, products, services, events and programs that may be organized, managed, facilitated, provided, sponsored and/or participated by BMC MALL;
  5. To provide you with information about the activities, products, services, events and programs offered by third parties that may interest you;
  6. To facilitate payment in connection with the business or contractual dealings between BMC MALL and you and/or your company;
  7. To conduct research, study, assessment, survey and or prepare reports or statistics for purpose of BMC MALL’s business activities;
  8. To respond to your queries;
  9. To enable the resolution of a concern or complaint;
  10. To comply with any legal or regulatory requirements applicable to BMC MALL and to make disclosure under the requirements of any law, regulation, direction, court order, by-law, guideline, circular or code applicable to BMC MALL;
  11. For recruitment of employees;
  12. For BMC MALL internal record keeping;
  13. For other business activities of BMC MALL; or
  14. For any other purpose(s) of the Purposes as BMC MALL shall deem fit and proper

Consequences of not providing the Personal Data

The failure to supply or provide the Personal Data to BMC MALL will potentially:-

  • Result in BMC MALL being unable to administer the business or contractual relationship between BMC MALL and you and/or your company;
  • Result in BMC MALL being unable to enter into a contract or agreement in relation to purchase of BMC MALL’s products and services with you;
  • Result in BMC MALL being unable to update you on BMC MALL’s products, services, promotions, activities, programs, events and/or launches organized, managed, facilitated, provided, sponsored and/or participated by BMC MALL or by selected third parties which may interest you;
  • Affect BMC MALL’s ability to accomplish the Purposes.

Disclosure of Personal Data

You hereby consent and authorize BMC MALL to provide or disclose or share or reveal the Personal Data to the following classes of users:-

  1. Related subsidiaries or associates or holdings companies, including future entities;.
  2. Government agencies, local authorities, utilities service providers, statutory authorities, enforcement agencies under the law and industry regulatory or other authorities if required or authorized to do so to discharge any regulatory function under any law or in relation to any order or judgment of court;.
  3. BMC MALL’s employees, auditors, consultants, accountants, lawyers, real estate agents, vendors, co-marketing partner, insurance company, property development and management manager and professional advisers;.
  4. BMC MALL’s contractors, sub-contractors or third parties service or product providers as may be determined by BMC MALL .
  5. BMC MALL’s appointed service providers in relation to BMC MALL’s loyalty programs for the purpose of delivery of gift redemption and services;.
  6. BMC MALL’s shareholders;.
  7. Financial institutions for purposes of facilitating payments and/or maintaining financial records in connection with the business or contract relationship between BMC MALL and you and/or your company; and.
  8. Any other third parties as BMC MALL may deem necessary and expedient.
Security of the Personal Data

Where necessary and appropriate, BMC MALL shall implement the appropriate administrative and security safeguards and procedures to protect and secure the Personal Data in accordance with the applicable personal data protection laws and regulations to prevent any unauthorized or unlawful processing of the Personal Data and the accidental loss or destruction of, or damage to, the Personal Data.

Data transfer & sharing

Where BMC MALL consider it is necessary or appropriate for the purposes of data storage or processing or providing any service or product on our behalf to you, BMC MALL may transfer the Personal Data to BMC MALL’s group of companies or any third party service or product providers within or outside the country in which BMC MALL's group of companies are established under similar conditions, confidentiality and level of security safeguards.

Right to access and/or correct

You may request to access to and/or correct the Personal Data at a prescribed fee (including personal data of others provided by you to BMC MALL) that is incorrect, incomplete, misleading and outdated ("the Request").

The Request shall be in writing and to be forwarded and sent to BMC MALL at info@bmcmall.my for security purposes and verification purposes and BMC MALL shall endeavor to comply with the Request. It is hereby agreed that the Request may be refused or rejected by BMC MALL without assigning any reason whatsoever.

If you do not approve BMC MALL’s use of the Personal Data for any other purpose(s) apart from the Purposes, you may notify BMC MALL by writing to BMC MALL at info@bmcmall.my and BMC MALL shall take all reasonable efforts to comply with your request.

Changes to the Notice

The Notice may be revised and updated from time to time. You may visit our website at www.bmcmall.my to review the most updated version of the Notice each time you provide the Personal Data to BMC MALL.

Conflict

In the event of any inconsistency between the English version and the Bahasa Malaysia version of the Notice, the English version shall prevail over the Bahasa Malaysia version.

NOTIS PERLINDUNGAN DATA PERIBADI

Pengenalan

Notis Perlindungan Data Peribadi ("Notis") dikeluarkan menurut Akta Perlindungan Data Peribadi 2010 ("Akta") untuk mengawal pengumpulan dan pemprosesan Data Peribadi anda (seperti yang ditakrifkan) oleh BMC MALL Sdn Bhd, anak-anak syarikat, syarikat bersekutu, entiti-entiti kawalan bersama, entiti-entiti kawalan bersama ("BMC MALL").

Jenis Data Peribadi Terkumpul

BMC MALL mungkin perlu mengumpulkan data peribadi daripada anda bagi tujuan aktiviti perniagaan atau urusan berkenaan dengan BMC MALL. Data-data tersebut adalah merangkumi nama, nama samaran, umur, nombor kad pengenalan, nombor pasport, alamat, jantina, tarikh lahir, status perkahwinan, maklumat pasangan / anak-anak, pekerjaan, profesion, jawatan, anggaran pendapatan, butiran pengenalan lain seperti alamat surat-menyurat, Nombor telefon/telefon bimbit, nombor faks, maklumat kad kredit, nombor akaun bank, alamat e-mel, maklumat majikan, bangsa, kewarganegaraan, tandatangan dan apa-apa data lain yang perlu maklumat ("Data Peribadi").

Persetujuan oleh Anda

Dengan memberikan Data Peribadi kepada BMC MALL, anda telah membaca dan menerima Notis yang anda telah bersetuju dengan pemprosesan Data Peribadi oleh BMC MALL seperti yang telah dinyatakan di sini. Selain itu, jika anda memberikan Data Peribadi pihak lain kepada BMC MALL, anda juga menjamin bahawa anda telah mendapatkan persetujuan mereka untuk pihak BMC MALL memproses Data Peribadi yang berkaitan seperti yang telah dinyatakan.

Tujuan Pengumpulan Data Peribadi

Data peribadi yang anda telah berikan akan diproses oleh BMC MALL bagi tujuan atau ("tujuan-tujuan") berikut:-

  1. Untuk pentadbiran perniagaan atau hubungan kontrak antara BMC MALL dan anda dan / atau syarikat anda;
  2. Untuk berkomunikasi dengan anda dan / atau syarikat anda;
  3. Untuk mentadbir prosedur pengurusan perhubungan pelanggan;
  4. Untuk memberikan anda maklumat mengenai sebarang aktiviti-aktiviti, produk-produk, perkhidmatan-perkhidmatan, acara-acara dan progam-program yang dikelola, diurus, disedia, ditaja dan / atau disertai oleh BMC MALL;
  5. Untuk menyediakan anda dengan maklumat mengenai aktiviti-aktiviti, produk-produk, perkhidmatan-perkhidmatan, acara-acara dan program-program yang ditawarkan oleh pihak tertentu yang mungkin menarik minat anda;
  6. Bagi bayaran yang berkaitan dengan urusan perniagaan atau kontrak antara BMC MALL dan anda dan / atau syarikat anda;
  7. Untuk menjalankan penyelidikan, kajian, penilaian, tinjauan dan/atau menyediakan laporan atau statistik bagi tujuan aktiviti perniagaan BMC MALL;
  8. Untuk maklum balas kepada pertanyaan anda;
  9. Untuk membolehkan penyelesaian terhadap sesuatu isu atau aduan;
  10. Untuk mematuhi mana-mana undang-undang atau peraturan yang berkaitan dengan BMC MALL dan untuk membuat pendedahan di bawah keperluan mana-mana undang-undang, peraturan, arahan, perintah mahkamah, , garis panduan, pekeliling atau kod yang melibatkan BMC MALL;
  11. Bagi pengambilan pekerja;
  12. Bagi simpanan rekod dalaman BMC MALL;
  13. Bagi lain-lain aktiviti perniagaan BMC MALL; atau
  14. Untuk lain-lain tujuan yang dianggap sesuai dan wajar oleh BMC MALL.

Akibat Kegagalan Memberi Data Peribadi

Jika anda gagal memberikan atau menyediakan Data Peribadi kepada BMC MALL, ia berpotensi untuk mengakibatkan:-

  • BMC MALL tidak dapat untuk mentadbir perniagaan atau menjalinkan hubungan kontrak antara BMC MALL dan anda dan / atau syarikat anda;
  • BMC MALL tidak dapat menjalinkan hubungan kontrak atau perjanjian berhubung dengan pembelian produk-produk dan perkhidmatan-perkhidmatan dengan anda;
  • BMC MALL tidak dapat mengemas kini kepada anda mengenai produk-produk, perkhidmatan-perkhidmatan, promosi-promosi, aktiviti-aktiviti, program-program, acara-acara dan/atau perlancaran-perlancaran yang dikelola, diurus, diselenggara, disedia, ditaja dan/atau disertai oleh BMC MALL atau oleh pihak lain yang mungkin menarik minat anda;
  • Keupayaan BMC MALL untuk mencapai tujuan-tujuan seperti yang dinyatakan terjejas.

Pendedahan Data Peribadi

Anda dengan ini bersetuju dan memberi kuasa kepada BMC MALL menyampaikan atau mendedahkan atau berkongsi Data Peribadi kepada kelas-kelas pengguna seperti berikut: -

  1. Laman Subsidiari-subsidiari atau sekutu-sekutu atau syarikat-syarikat pegangan berkaitan, termasuklah entiti-entiti di masa hadapan;
  2. Agensi-agensi kerajaan, pihak berkuasa tempatan, pembekal-pembekal perkhidmatan utiliti, badan-badan berkanun, agensi-agensi penguatkuasaan di bawah undang-undang dan industri kawal selia atau pihak berkuasa yang lain jika perlu atau dibenarkan untuk berbuat demikian untuk melaksanakan apa-apa fungsi kawal selia di bawah mana-mana undang-undang atau yang berhubungan dengan apa-apa perintah atau penghakiman mahkamah;
  3. Kakitangan BMC MALL, juruaudit-juruaudit, perunding-perunding, akauntan-akauntan, peguam-peguam, ejen-ejen hartanah, vendor-vendor, rakan pemasaran bersama, syarikat insurans, pembangunan hartanah dan pengurus pengurusan dan penasihat-penasihat profesional;
  4. Kontraktor-kontractor BMC MALL, sub-sub kontraktor atau perkhidmatan pihak ketiga atau pembekal-pembekal produk sebagaimana yang ditentukan oleh BMC MALL
  5. Pembekal-pembekal perkhidmatan yang dilantik oleh BMC MALL berhubung dengan program kesetiaan pelanggan bagi tujuan penghantaran hadiah penebusan dan perkhidmatan-perkhidmatan;
  6. Pemegang-pemegang saham BMC MALL;
  7. Institusi-institusi kewangan untuk tujuan memudahkan pembayaran dan / atau mengekalkan rekod kewangan yang berkaitan dengan urusan perniagaan atau kontrak di antara BMC MALL dan anda dan / atau syarikat anda; dan
  8. Mana-mana pihak ketiga yang lain yang dianggap BMC MALL sebagai perlu dan bersesuaian.

Keselamatan Data Peribadi

Mengikut keperluan atau kesesuaian, BMC MALL akan melaksanakan urusan pentadbiran, kawalan perlindungan dan prosedur-prosedur yang sewajarnya untuk melindungi dan menjamin keselamatan Data Peribadi selaras dengan undang-undang dan garis panduan perlindungan data peribadi untuk menghalang sebarang pemprosesan Data Peribadi yang tidak dibenarkan atau menyalahi undang-undang dan kerugian atau kemusnahan atau kerosakan yang tidak disengajakan terhadap Data Peribadi.

Pemindahan dan Perkongsian Data

Sekiranya BMC MALL mendapati ianya perlu atau wajar dipertimbangkan bagi tujuan penyimpanan data atau pemprosesan atau penyediaan sebarang perkhidmatan atau produk bagi pihak kami kepada anda, BMC MALL boleh memindahkan Data Peribadi tersebut kepada syarikat-syarikat kumpulan BMC MALL atau mana-mana perkhidmatan pihak ketiga atau pembekal-pembekal produk sama ada dalam atau luar negara selagi mana syarikat-syarikat tersebut ditubuhkan dibawah situasi-situasi,privasi dan tahap kawalan perlindungan yang lebih kurang sama.

Hak untuk Akses dan / atau Pembetulan

Anda boleh membuat permintaan untuk mengakses dan/atau membetulkan Data Peribadi yang salah, tidak lengkap, mengelirukan atau tidak dikemas kini (termasuklah Data Peribadi orang lain yang diberikan oleh anda kepada BMC MALL) dengan mengemukakan bayaran yang telah ditetapkan ("Permintaan tersebut").

Permintaan tersebut hendaklah dibuat secara bertulis dan hendaklah dikemukakan dan dihantar ke BMC MALL menerusi e-mel di info@bmcmall.my untuk tujuan keselamatan dan pengesahan. BMC MALL akan berusaha untuk memenuhi permintaan tersebut, walaubagaimanapun, permintaan tersebut juga boleh ditolak oleh BMC MALL tanpa apa-apa alasan sekalipun.

Sekiranya anda tidak bersetuju untuk BMC MALL menggunakan Data Peribadi untuk tujuan-tujuan lain selain dari Tujuan seperti yang telah dinyatakan,, anda boleh memaklumkan kepada BMC MALL secara bertulis menerusi e-mel di info@bmcmall.my dan BMC MALL akan meneliti dan mempertimbangkan untuk memenuhi permintaan anda.

Notis ini akan dikemaskinikan dari semasa ke semasa. Anda boleh melayari laman web kami di www.bmcmall.my untuk melihat versi Notis yang paling terkini setiap kali anda memberikan Data Peribadi kepada BMC MALL.
